Tulsa County Business Permits: Unincorporated Zoning Under the Tulsa County Zoning Code and a 0.367% County Sales Tax
Looking for a Tulsa County Oklahoma business license? You will not find one, because Tulsa County issues no general business license. Which permits you need depends on where your business sits and what it does. A business inside Tulsa, Broken Arrow, Owasso, Bixby, Jenks or Sand Springs follows its city's rules. A business on unincorporated land, meaning property outside city limits, deals with Tulsa County for zoning and building permits. Every business, wherever it sits, still deals with the state for its entity, sales tax and any state-issued licenses.
This guide covers how that split works, what the county handles, and the state filings that apply almost everywhere in the county.
This guide is informational only. It is not legal or tax advice. Zoning rules, agency responsibilities and fees change, so confirm every figure with the agency named before you spend money or sign a lease. For entity choice, tax registration or a zoning dispute, consult a qualified attorney or CPA.
Oklahoma Has No General State Business License
Oklahoma does not license a business simply for existing. Each business builds its own list of requirements from three sources:
- The Oklahoma Secretary of State, which forms the entity and handles trade names and name reservations.
- The Oklahoma Tax Commission (OTC), which registers the business through OkTAP if it collects sales tax or withholds tax.
- The state board, city or county that licenses the specific activity, such as a regulated trade, alcohol sales or food service.
The Oklahoma Department of Commerce notes that many common business activities need no state license at all, so check the activity list before assuming one applies.
Step One: Form the Entity With the Secretary of State
Most small businesses organize as an LLC or a corporation. The Business Filing Department handles both at sos.ok.gov/business, and you can search existing names at the business search.
An LLC files Articles of Organization for a $100 fee. The name must contain 'limited liability company,' 'limited company,' 'LLC,' 'LC,' 'L.L.C.' or 'L.C.' ('limited' may be 'Ltd.' and 'company' may be 'Co.'). It must also be distinguishable from other entity, trade and reserved names on file, including those filed within the last 3 years. You can reserve a name for $10 for 60 days at the name availability page.
The Secretary of State publishes no processing-time guarantee. Documents are handled in the order received, and in-person filings must arrive before 4:30 p.m. Central. Same-day service costs $50 per document and is available only for documents presented in person. Online turnaround is not published, so call the Business Filing office at 405-522-2520 before you plan a launch date around it.
The LLC Annual Certificate costs $25 and is due on the anniversary of the Articles of Organization. The LLC gets a 60-day grace period and there is no late fee. An LLC that misses the 60 days ceases to be in good standing. Reinstatement has no fee of its own, but you must file every delinquent annual certificate.
Oklahoma has no franchise tax for tax year 2024 and later. The franchise tax was repealed after tax year 2023, and LLCs were never subject to it. The $25 annual certificate is the only recurring state filing cost for a typical LLC. The Secretary of State's fee list also shows a $40 annual agent fee that applies where the Secretary of State acts as the LLC's registered agent, so ask whether it applies to yours.
A for-profit corporation files a Certificate of Incorporation. The fee is one-tenth of 1% of authorized capital stock, with a $50 minimum. Shares without par value count as $50 each, so 10,000 no-par shares carry a $500 fee, while 10,000 shares at $0.001 par pay the $50 minimum. Domestic for-profit corporations file no annual certificate with the Secretary of State. Not-for-profit corporations pay $25.
Every LLC and corporation needs a registered agent with a physical Oklahoma street address. A PO box does not qualify. The agent must be open during business hours to accept service of process. The agent can be the entity itself, an Oklahoma resident, or a qualifying business in good standing. Changing the agent or office costs $25.
Step Two: Register for Sales Tax Through OkTAP
If you sell taxable goods or services in Tulsa County, register for a sales tax permit at OkTAP. The permit costs $20 for three years. The state rate is 4.5%, and the Oklahoma Tax Commission collects city and county sales tax on the same return. Combined rates run from about 8.25% to above 10%, depending on where the sale occurs. Since August 29, 2024, the state rate does not apply to most food and food ingredients, but local taxes still do.
| Component (unincorporated Tulsa County) | Rate |
|---|---|
| State sales tax | 4.5% |
| Tulsa County sales tax | 0.367% |
| Subtotal before any city or special district tax | 4.867% |
The OTC rate file dated August 2026 displays the county rate as 0.37%, a rounded figure. The 4.867% subtotal does not include any city or special district tax, so confirm the full address-based rate on OkTAP before you set prices.
What Tulsa County Handles on Unincorporated Land
Only Oklahoma County and Tulsa County run zoning and building permits in unincorporated areas. Tulsa County's role covers land use and construction. It does not issue a business license for opening or operating a company.
Zoning Under the Tulsa County Zoning Code
The Tulsa County Zoning Code controls how land is used. It determines which uses are permitted in each zoning district and whether a use needs approval before you open. Before you sign a lease or buy property for a business, confirm that your intended use is allowed at that address.
Planning responsibilities were reported to shift in early September 2026 from the Tulsa Metropolitan Area Planning Commission (TMAPC) and INCOG to a new Tulsa County Planning Commission and Tulsa County Board of Adjustment. Because that transition is recent, confirm with Tulsa County and INCOG who now accepts zoning applications, which forms apply and what the current fees are. Do not rely on older fee schedules or contacts.
Building Permits Through Tulsa County Inspections
Tulsa County Inspections handles building permits for unincorporated areas. The office is at 218 W 6th St. The listed phone number is 918-596-5293, but confirm it with the county before you call. Ask whether your construction, renovation or change of use needs a permit before work starts, and do that before you hire a contractor or order materials.
Contractors and Trades
Cities license contractors separately, so a contractor working inside city limits follows that city's rules. On unincorporated land, the county building permit process applies. Some trades are licensed at the state level, through bodies such as the Construction Industries Board, so confirm which license your trade needs before you bid.
Alcohol, Health and Other Activity Permits
Ask Tulsa County whether its county beverage permit still applies to your business before assuming you need one. Alcohol licensing is handled by the Oklahoma ABLE Commission, so confirm your requirements with that agency as well.
The Tulsa Health Department is a city-county department, so confirm with it which review and permit steps apply to your location. Food establishment plan review carries a $425 fee at the state level. Confirm whether that fee and review apply to your specific operation.
Owners of business personal property, such as equipment and furnishings, must render it to the Tulsa County Assessor on Form 901 by March 15. The Assessor values business personal property from that filing. Confirm the filing details with the Assessor's office.
Trade Names and DBAs Are State Filings
If your business operates under a name other than the one on your Articles of Organization or Certificate of Incorporation, file a Trade Name Report with the Oklahoma Secretary of State. It is not filed with the county clerk, and no newspaper publication is required. The fee is $25 to file, amend, transfer or withdraw, with no annual fee. General partnerships file a Certificate of Partnership Fictitious Name for $50. Find the forms at the Secretary of State filing page.
City or County: Which Rules Apply
Start with one question: is the property inside city limits? If it is, the city licenses your activity. Tulsa issues no general city business license, but it licenses specific activity types. Some cities, such as Bixby, charge a general or occupational license, so confirm each city's list directly. Broken Arrow, Owasso, Jenks and Sand Springs follow the same process of checking with the city.
If the property is outside city limits, the county handles zoning and building permits, and the state handles most licensing.
